Prenuptial agreements are used when people who have significant assets before they marry or have children from former relationships whom they wish to protect after their remarriage.

Prenuptial agreements help establish each person’s expectations before they enter into marriage. Such agreements can change the general rules that apply to married people if the marriage ends in divorce or death.

Each person’s assets and debts should be inventoried as part of the agreement, and each party should have their own attorney review the proposed agreement before signing it.

Both parties should completely understand what the agreement states about their rights to the property of the other and how this changes the general laws of dividing property during divorce or after death of a spouse.
